NEW TO THE PROCESS?

  • WHAT IS CONVEYANCING?

    Conveyancing is the term given to the transfer of the legal ownership of property from one person to another. While this sounds simple, conveyancing is actually a very complex and involved process, filled with conditions and deadlines. It includes necessary checks and searches that ensure that the seller legally owns the property, what the council rates, water rates ect. are, and that the property is legally compliant with council regulations and that the seller's ownership is free of encumbrances. 


    Our Conveyancers will guide you through the conveyancing process and ensure that your legal rights are protected every step of the way and your obligations are met. 

  • DO I NEED A CONVEYANCER OR A SOLICITOR?

    Both a conveyancer and a solicitor can act on behalf of a client to organise the legal transfer of property, however a conveyancer is specialised in the area of conveyancing and are experts in property transfers.

  • WHAT IS STAMP DUTY?

    Stamp Duty is a tax paid to the State Government upon the transferring of ownership in property. It is payable by the buyer of a property and the amount to be paid is determined by the purchase price of the property. Depending on whether you are buying a house to live in, or as an investment the amount of transfer duty payable will also differ. There are also currently concessions available to First Home Buyers, Health Care Card Holders or Pension Card Holders in Victoria.

  • DO I NEED TO VISIT THE OFFICE DURING THIS PROCESS?

    Not necessarily. Of course you are most welcome to arrange an appointment to meet with Alyce, However, As all settlements are now done electronically your transaction can also be completed via phone, email and post.

  • WHAT IS INVOLVED IN THE CONVEYANCING PROCESS WHEN PURCHASING?

    When you purchase a house, unit/apartment or Land and have us manage the conveyancing process we will:

    • Review the Contract of Sale to ensure your rights are protected, (if you engage us before signing); 
    • Identify and notify you of all key dates and issues in the Contract, ensuring that each of these are met;
    • Conduct searches into the property to ensure there are no issues with it, or hidden surprises;
    • Liaise with your bank and all of the other party's legal representatives;
    • Keep you informed throughout the process;
    • Complete your Verification of Identity in-house;
    • Calculate all the final figures, adjusting to take into account rates, water, body corporate and land tax; 
    • Arrange settlement of the purchase; 
    • Advise authorities of Change of Ownership; and
    • Ensure everything is finalised and taken care of after settlement.
  • WHAT IS INVOLVED IN THE CONVEYANCING PROCESS WHEN SELLING?

    When you sell a house, unit/apartment or Land and have us manage the conveyancing process we will:

    • Prepare a Section 32 Statement and contract of Sale.
    • Review the Contract of Sale once the purchaser has signed to ensure your rights are protected.
    • Identify and notify you of all key dates; 
    • Liaise with your bank and all of the other party's legal representatives; 
    • Keep you informed throughout the process; 
    • Check the purchasers calculation of the final figures;
    • Arrange settlement of the sale; 
    • Advise authorities of Change of Ownership; and
    • Ensure everything is finalised and taken care of after settlement.
  • DO I NEED TO COMPLETE A VERIFICATION OF IDENTITY?

    Yes as of 9 November 2015, a person must have their identity verified if they sign a document to be lodged with the Land Registry in relation to particular transactions.

    The verification process involves you attending a VOI interview with one of our staff members or you can attend an Australia Post Outlet.

    At the VOI interview, you must produce original documents that verify you are the person you purport to be and they must be genuine and current. There are various Categories of documents that you may produce but you must produce - 

    • The highest category of documents possible, and

    Every document required for that Category.

    We are required to take copies of the documents provided at the VOI interview.

    Most Categories require a passport, driver's licence or Government issued card with photo evidencing age and/or identity.
